1. Agreement & eligibility
These Terms form a binding agreement between you and FragBytes governing your access to and use of fragbytes.com. By using the Site, you confirm you are at least 13 years old (or 16 in the EU/UK/EEA, where applicable).
2. License to use the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include any right to: republish content without permission; use our content to train ML/AI models without an explicit written agreement; reproduce more than short, attributed quotations; or scrape the Site.
3. Acceptable use
- Use the Site lawfully.
- Do not attempt unauthorized access.
- Do not interfere with or disrupt the Site.
- Do not use automated systems outside published
robots.txtrules. - Do not impersonate any person or organization.
- Do not submit content that is unlawful, defamatory, infringing, or harmful.
4. Intellectual property
All content published on the Site is owned by FragBytes or our licensors and is protected by copyright, trademark, and other IP laws. “FragBytes” and the FragBytes wordmark are unregistered trademarks of FragBytes.
5. User-generated content
If you submit content (comments, tips, contact-form messages), you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display that content. You retain ownership.
6. Affiliate links & sponsored content
Sponsored content is always clearly labeled as such, distinguished visually from editorial content, and never written by the sponsor.
7. Disclaimers
The Site and its content are provided “as is” and “as available“, without warranties of any kind, express or implied.
8. No financial, investment, or professional advice
Cryptocurrency and digital-asset markets are highly volatile and involve substantial risk of loss. Past performance does not predict future results.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event will FragBytes be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total aggregate liability for any claim will not exceed the greater of (a) one hundred US dollars (USD $100) or (b) the amounts you have paid us in the twelve months preceding the claim.
Some jurisdictions do not allow these exclusions; in those jurisdictions, our liability is limited to the maximum extent permitted by applicable law, and nothing here excludes liability for fraud, gross negligence, willful misconduct, or any other liability that cannot be excluded.
10. Indemnification
You agree to indemnify, defend, and hold harmless FragBytes from any claims arising out of: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right.
11. Third-party services and links
The Site may contain links to or integrations with third-party services we do not control. We are not responsible for any third-party service.
12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or applicable law.
13. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts of Delaware, except as provided below.
This choice does not deprive you of the protection of mandatory provisions of the law of your country of residence.
14. EU / UK consumer rights
Nothing in these Terms limits or excludes any of your statutory rights as a consumer. If you are a consumer in the EU or UK, you may bring legal proceedings in the courts of the country in which you live. The EU online dispute resolution platform is at ec.europa.eu/consumers/odr.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and provide reasonable advance notice.
